How to privatize housing: who has the right and what documents to collect

If you have a warrant for the state or municipally owned housing in which you live (apartment, house, dormitory room, etc.), you can privatize it. What is needed for this - lawyers from the legal aid system tell us.

What kind of housing can be privatized?

  • apartments in apartment buildings
  • single-family homes
  • living quarters in dormitories (rooms, residential blocks, sections)
  • rooms in apartments and single-family houses where two or more tenants live, which are used by citizens on a rental basis.

Someone who has a housing warrant

What are the conditions for privatization?

Written consent of all adult family members living together is required.
Privatization is issued for all family members, including those temporarily absent (indicating the type of ownership: joint, joint ownership or joint partial ownership).

What documents are required?

  • application for privatization
  • copies of documents proving identity and citizenship of Ukraine
  • taxpayer card
  • documents about family ties (birth certificates, marriage certificates, etc.)
  • certificates of registration of the place of residence of the applicant and family members
  • technical passport for housing
  • copy of the housing order
  • certificate of non-use of housing vouchers for privatization (issued by the ASC)
  • documents proving the right to preferential conditions (if necessary)
  • statement of consent from temporarily absent family members.

How is a privatization decision made?

  1. The privatization authority makes a decision on the transfer of ownership of housing.
  2. A certificate of ownership is issued.
  3. The certificate is registered with the state registration authority.

Everyone can get free legal advice from the free legal aid system. Lawyers will advise you on how to act in your situation.

Some categories of people are also entitled to free legal aid when applying to court. These are IDPs, children, people with low incomes (able-bodied people – with income up to 6056 UAH/month; pensioners (by age, years of service) – 4722 UAH/month; disabled people – if their pension or social assistance is up to 6056 UAH), war veterans (other categories are listed in Article 14 of the Law of Ukraine «On Free Legal Aid»). Lawyers will study your circumstances in detail, if necessary, prepare and submit a statement to the court, and represent your interests in court.
