Important information for consumers of services of the Communal Enterprise "Chuguyiv Communal Complex"!
Resolution of the Cabinet of Ministers of Ukraine dated August 8, 2023 No. 835 approved the "Rules for the Provision of Household Waste Management Services", which establish that services are provided to the consumer in accordance with the terms of the contract concluded in accordance with standard contracts for the provision of household waste management services.
In accordance with Article 33 of the Law of Ukraine «On Waste Management», Article 12 of the Law of Ukraine «On Housing and Communal Services», Resolution of the Cabinet of Ministers of Ukraine dated August 8, 2023 No. 835 «On Approval of the Rules for the Provision of Household Waste Management Services and Model Agreements for the Provision of Household Waste Management Services», Decision of the Executive Committee of the Chuguiv City Council of Kharkiv Region No. 56 dated July 15, 2022 «On Determining the Service Provider for the Implementation of Operations for the Implementation and Transportation of Household Waste in the Territory of the Chuguiv Urban Territorial Community of the Chuguiv District of the Kharkiv Region», the Municipal Enterprise «Chuguivskyi Communal Complex» publishes this public offer (offer) for the conclusion of an agreement for the provision of household waste management services.
This agreement is a public agreement of accession, which is concluded by the parties in accordance with Article 13 of the Law of Ukraine "On Housing and Communal Services", taking into account Articles 633, 634, 642 of the Civil Code of Ukraine, by the consumer's accession to the terms of this agreement as a whole.
We inform you that the fact of the consumer's adherence to the terms of the contract is the acceptance of the offer to conclude a contract (acceptance), the consumer's performance of any actions that indicate his desire to conclude a contract, in particular, providing the contractor with a signed application for concluding a contract (annex to the contract), payment of the invoice for the service provided, and the fact of consuming the service.
By virtue of the provisions of Part One of Article 25 and Part Five of Article 13 of the Law of Ukraine "On Housing and Communal Services", which indicate the Consumer's obligation to conclude an agreement on the provision of housing and communal services, in particular, an agreement on the provision of household waste management services, and make it impossible for the Consumer to refuse to conclude this agreement, the Consumer's acceptance of the offer of the Contractor of household waste management services under this agreement takes place in the form of silence in accordance with Part Three of Article 205 of the Civil Code of Ukraine from the date of entry into force of this agreement, determined in accordance with the provisions of the Law of Ukraine "On Housing and Communal Services".
The application for accession is submitted by the consumer in person at the address: Centralny Boulevard, 1Zh, Chuhuyiv, Chuhuyiv district, Kharkiv region, 63503.
Considering the above, the KP "Chuguyiv Communal Complex" announces the official publication of the Public Agreement on the provision of household waste management services.
Additionally, we inform you that the termination of a previously concluded contract for the provision of household waste management services does not release the consumer from the obligation to pay for the service until the conclusion of a new contractual relationship.
