Employees whose activities are related to serving the population must undergo mandatory preventive medical examinations. This is not a formality or an "extra paper requirement", but one of the important tools for preventing infectious diseases and protecting people's health.
These are those areas where, while performing their duties, an employee comes into contact with food products, drinking water, children, patients, visitors, household services or other areas of public service. In particular, these are food industry, catering and trade enterprises, educational institutions, preschools, health and medical institutions, water supply, municipal and household services facilities, hotels, hostels, baths, saunas, beauty salons, pharmacies and other facilities,
defined by law.
The procedure for mandatory preventive medical examinations is determined by Article 21 of the Law of Ukraine "On Protection of the Population from Infectious Diseases", Article 45 of the Law of Ukraine "On the Public Health System", Resolution of the Cabinet of Ministers of Ukraine dated 05/23/2001 No. 559 and Order of the Ministry of Health of Ukraine dated 07/23/2002 No. 280.
The purpose of such inspections is simple and clear: to identify possible risks to people's health in a timely manner and to prevent people whose health condition may pose a danger to others from working.
The employer is responsible for organizing and timely completion of mandatory medical examinations by employees. It is the employer who must monitor that employees undergo examinations within the established deadlines, have properly executed personal medical records, and are not allowed to work without the necessary medical certificate.
Employees who, without good reason, have not undergone a mandatory medical examination in full and within the established time frame are subject to suspension from work in accordance with the requirements of the law.
To organize a periodic medical examination, the employer draws up a list of employees who must undergo such an examination and submits it for approval to the territorial body of the State Service for Food Safety and Consumer Protection. After approval, a copy of the list is transferred to the healthcare institution where the medical examination will be conducted.
When compiling the lists, it is necessary to take into account the current requirements of the Resolution of the Cabinet of Ministers of Ukraine No. 559 and the Order of the Ministry of Health of Ukraine No. 280, in particular the amendments made by the Order of the Ministry of Health of Ukraine dated 08.11.2023 No. 1925 and the Order of the Ministry of Health of Ukraine dated 24.11.2023 No. 2002.
Mandatory medical examinations are conducted by healthcare institutions that have a license to conduct business activities in medical practice. The results of the examinations are drawn up in accordance with the requirements of the legislation, in particular, with the necessary data entered into the medical documentation and the employee's personal medical book.
