We inform entrepreneurs conducting commercial activities in the community about convenient ways for them to accept non-cash payments from consumers!

The Law of Ukraine "On Payment Services" (hereinafter referred to as the Law) establishes that traders are obliged to provide the possibility of making non-cash payments for goods sold (services provided), including using electronic payment instruments and/or payment applications, and/or payment devices (Article 38).

In accordance with the Law, on July 29, 2022, Resolution No. 894 of the Cabinet of Ministers of Ukraine (hereinafter referred to as Resolution No. 894) was adopted, which establishes the deadlines by which traders must ensure the possibility of making non-cash payments (including using electronic payment instruments, payment applications or payment devices) for goods sold (services provided) by them, including goods (services) sold (provided) remotely.

From January 1, 2026, traders - individual entrepreneurs - payers of the first group of the single tax, traders who trade using vending machines, on-site (remote) trade, and sell self-grown or fattened products must ensure the possibility of making cashless payments.

It should be noted that Resolution No. 894 does not establish the obligation for a merchant to provide a method of non-cash payments exclusively using a payment terminal. Non-cash payments are, in particular, the transfer of funds from payers' accounts to recipients' accounts (Article 1 of the Law). The Law does not limit merchants in the methods of providing non-cash payments and provides the merchant with the opportunity to provide non-cash payments by using payment applications, providing the consumer with the details of his account/payment instrument (in particular, an electronic payment instrument), which will allow the consumer to pay for goods (services provided) to the merchant's account.

That is, the merchant must have a current account of an individual entrepreneur so that payers have the opportunity to make payments to this account using its number (IBAN).

For the convenience of transferring funds, the merchant can generate a QR code by contacting the bank branch where his current account is opened or independently.

To generate a graphic QR code online, you can use free services such as Pageloot, ME-QR, Get-QR, or My QR Code.

We also draw your attention to the fact that, in accordance with Article 296.10 of the Tax Code of Ukraine, single tax payers of the first group do not use settlement transaction registrars and/or software settlement transaction registrars (STR/STR). The obligation to provide payers with the opportunity to make non-cash payments does not oblige them to use STR/STR.
