
In accordance with the requirements of the Law of Ukraine "On the Basic Principles of State Supervision (Control) in the Sphere of Economic Activity", Article 202 of the Law of Ukraine "On Environmental Protection", in order to implement the Instruction of the State Ecological Inspectorate of Ukraine No. 373 dated March 12, 2025 "On Strengthening Measures of State Supervision (Control) over Compliance with Fire Safety Requirements and Environmental Legislation", the State Ecological Inspectorate in the Kharkiv Region emphasizes compliance with fire safety requirements and environmental legislation on the territory of the Chuguiv urban territorial community.
Every year, state supervision (control) measures are strengthened on the territory of Ukraine to ensure compliance with fire safety requirements and environmental legislation, because in the spring and autumn periods of the year, grasses and reeds are burned, and in the summer - nutrient residues. As a result of such actions, the microflora and fauna of the upper soil layer are destroyed, insects and their larvae, plant pollinators, earthworms and other organisms that participate in the process of soil formation die, as well as small animals, birds and their nesting sites. The composition of grasses is depleted, since the seeds of annual, biennial and some perennial plants are destroyed, the layer of dry grass is destroyed, which retained moisture, rotted and created the necessary conditions for the existence of many plants, animals and insects, formed the soil. Soil fertility, humus content are reduced, their structure deteriorates, and erosion resistance decreases.
We also remind you that liability for violation of the above norms of current legislation is determined by Article 771 of the Code of Ukraine on Administrative Offenses, namely, burning stubble, meadows, pastures, areas with steppe, wetland and other natural vegetation, vegetation or its remains and fallen leaves on agricultural lands, in the right-of-way of highways and railways, in parks, other green spaces and lawns in settlements without following the procedure established by the central executive body that ensures the formation of state policy in the field of environmental protection, entails the imposition of a fine on the guilty parties:
- for citizens – from 180 (3060 UAH) to 360 (6120 UAH) non-taxable minimum incomes of citizens;
- for officials – from 900 (15,300 UAH) to 1,260 (21,420 UAH) non-taxable minimum incomes of citizens.
The same actions committed within the territories and objects of the nature reserve fund entail the imposition of a fine:
- for citizens – from 60 (1020 UAH) to 720 (12240 UAH) non-taxable minimum incomes of citizens;
- for officials – from 1260 (21420 UAH) to 1800 (30600 UAH) non-taxable minimum incomes of citizens.
In addition, on November 15, 2009, the Law of Ukraine No. 1708-U1 «On Amendments to Certain Legislative Acts of Ukraine Regarding Liability for Offenses in the Environmental Sphere» came into force, which amended Article 245 of the Criminal Code of Ukraine, and it is set out in the following wording: destruction or damage to forest areas, green plantings around settlements, dry wild herbs, vegetation or its remains on agricultural lands by fire or other generally dangerous means - shall be punishable by a fine of three hundred to five hundred non-taxable minimum incomes of citizens or restriction of liberty for a term of two to five years, or imprisonment for the same term. The same actions, if they caused the death of people, mass death of animals or other grave consequences, shall be punishable by imprisonment for a term of five to ten years.
