
If child support is collected as part of the income of one of the parents, it is collected from all types of income. This also applies to the income of military personnel - child support is collected from all types of their financial support: official salary, salary by military rank, seniority bonus, monthly allowances, supplements, rewards, other payments, in particular an additional reward in the amount of UAH 100,000.
The amount of alimony, if ordered by the court:
- for one child - 1/4 of the payer's income;
- for two children - 1/3 of the payer's income;
- for three or more children – 1/2 of the payer's income, but not more than ten subsistence minimums per child of the appropriate age for each child.
Minimum and maximum amount of alimony:
- under 6 years old - 1281.5 UAH - 25,630 UAH;
- from 6 to 18 years old - 1598 UAH - 31,960 UAH.
Can the amount of alimony be changed?
Yes. The amount of child support can be increased or decreased.
You can also change the method of collecting alimony. If a specific amount of alimony was previously established (alimony in a fixed amount of money), then you can change this to a portion of the payer's income. Or vice versa. This can be done by personal agreement or by court decision.
Grounds for changing the amount of alimony:
- changes in the financial or family status of the payer or recipient of alimony;
- deterioration or improvement in the health of any of them;
- in other cases (the child is in full state or religious custody, etc.).
If a serviceman does not voluntarily pay alimony, it is necessary to go to court. And obtain a court order to collect alimony. This court order must be sent for execution to the military unit in which he serves.
If it is not known in which unit the soldier serves
It is necessary to contact the local enforcement service or private enforcement agent. The enforcement agent must send a request to the Ministry of Defense to obtain this information. After that, the state (private) enforcement agent must send the court order to this military unit for execution.
If the state enforcement officer does not take action to collect
You can write a complaint to the head of the enforcement service that opened the enforcement proceedings. If there is no result, then to the Ministry of Justice.
