Pensions for long service, disability or in case of loss of breadwinner in accordance with the Law of Ukraine dated 09.04.1992 No. 2262 "On pension provision for persons discharged from military service and certain other persons" are assigned after discharge from military service (if entitled).
The law defines, among other things, the right to a pension for conscripts and the categories of persons who have the right to a pension on an equal basis with conscripts.
This division is important for distinguishing the procedure for applying for a pension: which body to apply to, and in what way.
Military personnel on conscription and persons who are provided with a pension on a par with military personnel on conscription, members of their families who are assigned disability pensions or in case of loss of a breadwinner are applying with an application and necessary documents to the territorial body of the Pension Fund of Ukraine.
This procedure applies, in particular, to:
- persons who became disabled due to injury, mutilation, contusion or as a result of a disease related to direct participation in the period from February 24 to March 25, 2022 in measures necessary to ensure the defense of Ukraine, protect the security of the population and the interests of the state in connection with the military aggression of the Russian Federation against Ukraine, during the period of martial law as a result of self-defense while performing tasks related to the introduction and implementation of measures of the legal regime of martial law (except for employees of enterprises, institutions, organizations that were involved and took direct part in the implementation of measures necessary to ensure the defense of Ukraine, protect the security of the population and the interests of the state in connection with the military aggression of the Russian Federation against Ukraine, being directly in the areas and during the implementation of the specified measures), disability pensions are assigned to them in accordance with Law No. 2262 starting from 04.04.2025;
- family members who apply for a survivor's pension for a deceased breadwinner who was receiving a military pension.
Methods of submitting documents:
- in person – to the service center of the Pension Fund of Ukraine;
- online – through the web portal of electronic services of the Pension Fund of Ukraine.
Military personnel discharged from service, other persons (except military personnel on conscription), members of their families (if a pension was not assigned to the deceased breadwinner) submit applications for the assignment of pensions to the Pension Fund of Ukraine. through an authorized body (structural unit), which prepares the documents necessary for the assignment of pensions, the power ministry or department at the last place of service (for example, through the CCC of the SP).
If the person is not dismissed from service
If a military serviceman who is serving, disability is established or the serviceman - participant in hostilities has reached the age of: men - 55 years, women - 50 years, an application for the assignment of a disability pension or early retirement pension in accordance with the Law of Ukraine dated 09.07.2003 No. 1058 "On Compulsory State Pension Insurance" is submitted to the territorial body of the Pension Fund of Ukraine - in person or online.
Importantly! In this case, the right to a pension (for disability or for old age) is determined taking into account the insurance experience acquired by the person.
After discharge from service, a pension may be awarded under military law.
