
The Ministry of Veterans Affairs, in its letter dated July 10, 2024, No. 11203/1.5/6.2-24, spoke about additional guarantees in promoting employment for combatants.
In accordance with Part One, Clause 8, Article 14 of the Law of Ukraine «On Employment of the Population», the categories of citizens who have additional guarantees in promoting employment include, in particular, participants in hostilities, specified in Clauses 19–21, Part One, Article 6 of the Law of Ukraine «On the Status of War Veterans, Guarantees of Their Social Protection».
The availability of these guarantees means that in accordance with Part Two of Article 26 of the Law of Ukraine "On Employment of the Population", an employer who, upon the direction of the territorial bodies of the State Employment Service, employs for a period of not less than one year persons who have no more than five years left before the right to an old-age pension, persons specified in paragraphs 6 and 8 of Part One of Article 14 of this Law, and who have been registered unemployed for more than one month, shall be compensated for 50 percent of the actual labor costs, but not more than the minimum wage. The total duration of compensation payment is six months.
Also, according to Article 42 of the Labor Code of Ukraine, when reducing the number or staff of employees due to changes in the organization of production and labor, the preferential right to remain at work is granted to employees with higher qualifications and labor productivity. Under equal conditions of labor productivity and qualifications, the advantage in remaining at work is granted, in particular, to participants in hostilities.
At the same time, in accordance with Article 421 of this Code, the preferential right to conclude an employment contract in the event of re-employment is granted to persons specified in Article 42 of this Code and in other cases provided for by the collective agreement.
