Report on reserved employees by July 10
The obligation to submit reports on reserved employees is provided for by the Law "On Mobilization Training and Mobilization" dated 21.10.1993 No. 3543-XII (further — Law No. 3543), in particular, Part 1 of Article 21 states:
Enterprises, institutions and organizations are obliged to:
maintain military records of conscripts, military conscripts, and reservists from among the employed, take measures to reserve military conscripts for the mobilization period and during special periods, and provide reports on these issues to relevant state authorities, other state bodies, and local self-government bodies in accordance with the established procedure;
Law No. 3543 provides similar requirements for government bodies and local governments.
Also in paragraph 14 of the Procedure for booking military conscripts during martial law dated 01/27/2023 No. 76 (further — Order No. 76) states:
State authorities, other state bodies, local governments, enterprises, institutions and organizations shall prepare a quarterly report on the number of military conscripts who are booked in accordance with this Procedure, as of the 1st of the month following the reporting quarter.
That is Reporting for the II quarter of 2024 must be submitted for all military conscripts who are booked as of July 1, 2024.
Separate report forms for different entities are provided in the annexes to Procedure No. 76. The deadlines for submitting reports are also determined separately for different entities.Importantly! Reporting on the number of reserved employees is one of the requirements of the legislation on defense, mobilization training and mobilization in a special period. In wartime, administrative liability is applied for violation of such requirements in accordance with Part 3 of Article 210-1 of the Code of Administrative Offenses. From 05/19/2024, the amount of the fine for officials of state authorities, local governments, legal entities and public associations is from 2,000 to 3,500 non-taxable minimum incomes of citizens, i.e. from UAH 34,000 to UAH 59,500.
