The Cabinet of Ministers of Ukraine has approved a mechanism for recognizing a person as a victim of sexual violence related to the armed aggression of the Russian Federation against Ukraine and assigning such a person an immediate cash payment.
Who is entitled to receive payment?
The right to receive immediate cash payments is granted to persons who have been officially recognized by the Commission established under the Ministry of Social Policy as victims of sexual violence related to the armed aggression of the Russian Federation against Ukraine.
In cases provided for by law, payment may also be made the legal representative of the injured person
Simultaneously This Procedure does not apply to persons who have already received the relevant payment within the framework of the pilot project of urgent interim reparations implemented in accordance with the Framework Agreement of December 21, 2023.
How is the payment assigned?
A person who considers himself a victim shall submit an application for recognition as a victim to the Commission for consideration of issues related to the recognition of a person as a victim of sexual violence related to the armed aggression of the Russian Federation against Ukraine. It shall be submitted in the form specified in the Procedure for submitting an application for recognition as a victim of sexual violence related to the armed aggression of the Russian Federation against Ukraine.
The following shall be attached to the application:
- a copy of an identity document;
- a copy of the child's birth certificate or an extract from the State Register of Civil Status Acts of Citizens regarding birth if the application is submitted by the legal representative of a child under 14 years of age;
- a copy of the document certifying the identity of the legal representative and a document confirming his authority as a legal representative, if the application is submitted by a legal representative;
- documents and materials or their copies that can confirm the circumstances and facts indicating that the person is a victim of sexual violence related to the armed aggression of the Russian Federation against Ukraine, in particular certificates, medical certificates, extracts from accounting journals, if available;
- informed consent of the affected person or their legal representative
- a certificate with the details of the bank account opened in the name of the recipient of the urgent cash payment or his legal representative. Such a certificate is not submitted if the affected person has already received a payment under the pilot project of urgent interim reparations.
The basis for awarding the payment is the Commission's decision to recognize the person as a victim.
After making such a decision, the Commission shall transmit to the Ministry of Social Policy, Family and Unity:
- extract from the minutes of the Commission's decision;
- bank account details of the injured person or their legal representative.
After receiving these documents The Ministry transfers funds.
How is the payment made?
Emergency cash assistance is paid one-time in the amount of 3,000 euros by transferring funds to the personal bank account of the affected person or their legal representative.
Funds are transferred from a special registration account of the Ministry of Social Policy, Family and Unity, opened in the bodies of the State Treasury Service of Ukraine.
The procedure establishes that payments are made in order of priority:
- according to the date of adoption of the decision by the Commission;
- taking into account the order of receipt of applications.
Does this benefit affect other social benefits?
No. Immediate cash payment not taken into account when calculating the average monthly total family income.
This means that its receipt does not affect on the right of a person to receive:
- state social assistance;
- housing subsidies;
- benefits;
- other social benefits financed from state or local budgets.
This benefit is paid regardless of whether the affected person receives other government benefits or types of social support.
What funds are used to make the payment?
A feature of this mechanism is that financing is carried out not at the expense of the State Budget of Ukraine.
The source of funding is voluntary contributions international governmental and non-governmental organizations, international partners, charitable foundations, legal entities and individuals, which are transferred to a special account of the Ministry of Social Policy, Family and Unity, opened at the National Bank of Ukraine.
That is why the Procedure directly provides that payment is made only if there are appropriate financial revenues.
