Residents of deoccupied territories who were injured or harmed by explosive devices during the occupation can establish the status of a person with a disability as a result of the war. Lawyers from the free legal aid system explain how to do this.

If the injury occurred during the occupation

This does not require a separate causal connection between the disability and the hostilities during the occupation.

This can only be done after the deoccupation of the territory.

How to determine health damage

  1. Contact a forensic expert to confirm damage from an explosive object.
  2. Submit an application to the interdepartmental commission under the Ministry of Veterans Affairs (MVA) to establish the fact of health damage as a result of hostilities.

How to apply to the interdepartmental commission

In paper form - by mail or ASC.

In electronic form - to the official email address of the Ministry of Veterans Affairs [email protected].

What documents are needed?

  • identity document
  • taxpayer card
  • forensic medical examination report
  • certificate of good conduct
  • an extract from the decision of the expert team on the assessment of the person's daily functioning or a certificate from the MSEC or a conclusion from the LCC of a healthcare institution on the establishment of the category "child with disabilities" for a person under the age of 18«
  • extract from the ERDR on the initiation of criminal proceedings
  • other documents confirming the injury (if available).

Consideration periods

Within 1 month.

If updated information is received, the deadline is extended by 15 days.

Decisions must be sent within 3 business days of adoption.

What to do after receiving the decision

  1. Contact your doctor with the decision of the interdepartmental commission.
  2. Within 5 days, an expert team assessing the person's daily functioning establishes a causal relationship between the disability and health damage from explosive objects and issues a corresponding extract.
  3. With this extract, contact the Veterans Policy Department of the RDA to obtain:
  4. war disability certificate
  5. breastplate "War veteran - a person with a disability as a result of war.".

Some categories of people are also entitled to free legal aid when applying to court. These are IDPs, war veterans, family members of deceased defenders, children, people with low incomes (able-bodied people – with income up to 6056 UAH/month; pensioners (by age, years of service) – 4722 UAH/month; disabled people – if their pension or social assistance is up to 6056 UAH), and other categories listed in Article 14 of the Law of Ukraine «On Free Legal Aid». Lawyers will study your circumstances in detail, if necessary, prepare and submit a statement to the court, and represent your interests in court.
