What unscheduled inspections does the State Labor Service conduct during martial law?

We remind you that the Law of Ukraine "On the Organization of Labor Relations under Martial Law" dated March 15, 2022 No. 2136-IX prohibits the State Labor Service from conducting scheduled inspections during martial law.

However, unscheduled inspections are permitted. However, the grounds and subject matter of such measures are limited.

During the period of martial law, the State Labor Service is allowed to carry out unscheduled measures in the field of labor protection, occupational hygiene, as well as in matters of supervision and control over compliance with labor legislation for the following reasons:

  • verification of the implementation by the business entity of regulations, orders or other administrative documents regarding the elimination of violations of legal requirements issued based on the results of a previous measure by the state supervision (control) body;
  • an appeal by an individual (individuals) about a violation that caused harm to his (their) rights, legitimate interests, life or health, the environment or the security of the state, with the addition of documents or copies thereof confirming such violations (if any). In such a case, an unscheduled measure is carried out by the territorial body of state supervision (control) with the approval of the central executive body that implements state policy in the relevant sphere of state supervision (control), or the relevant state collegiate body;
  • an order of the Prime Minister of Ukraine to inspect business entities in the relevant field in connection with identified systemic violations and/or the occurrence of an event that has a significant negative impact on human rights, legitimate interests, life and health, environmental protection and ensuring state security;
  • the occurrence of an accident, fire, death of a victim as a result of an accident or occupational disease, which was related to the activities of the business entity.

In addition, on April 15, the Verkhovna Rada adopted as a whole Bill No. 11044, which abolished inspections for employers in the event of mobbing against employees. This Act is currently being submitted to the President for signature.
