The Cabinet of Ministers of Ukraine, by its resolution No. 360 dated March 28, 2025, amended the resolution of the Cabinet of Ministers of Ukraine dated January 27, 2023, No. 76.
Changes have occurred:
- Procedure for booking military conscripts for the period of mobilization and wartime (hereinafter referred to as Procedure No. 76).
- Criteria and procedure for determining enterprises, institutions and organizations that are critically important for the functioning of the economy and ensuring the livelihoods of the population in a special period, as well as critically important for ensuring the needs of the Armed Forces and other military formations in a special period (hereinafter referred to as Criteria No. 76).
One hundred percent reservation was received by employees of the State Enterprise of the Ministry of Defense of Ukraine "Defense Procurement Agency" and the State Enterprise of the Ministry of Defense of Ukraine "State Rear Operator", authorized by the Ministry of Defense to perform the functions of the state customer service in the defense sector, for the purpose of conducting defense procurement and concluding state contacts (contracts) for the purchase of goods, works and services.
The requirement to accrue a salary of UAH 20,000 as a prerequisite for reserving military service will also not apply to employees of business entities - producers of electricity and heat energy, which include production (generating) capacities that were destroyed or damaged as a result of the armed aggression of the Russian Federation, enterprises servicing facilities included in the sectoral list of critical infrastructure facilities of the life support system sector, plus - oil refining enterprises, in the authorized capital of which more than 25% shares (shares) belong to the state.
It has been determined that the maximum number of military personnel booked in 75% applies to enterprises that produce and transport thermal energy and provide services to consumers in the supply of thermal energy, centralized hot water supply, centralized water supply and centralized wastewater disposal, and household waste management.
The total number of conscripts specified in paragraphs 6-10 of Order No. 76 will not include conscripts booked for other enterprises, institutions, and organizations (previously, only female conscripts and conscripts specified in paragraphs 2-6 of paragraph 5 of Order No. 76 were not taken into account.
The features of booking or canceling a postponement have been determined:
- military personnel who hold the positions of prosthetists-orthetists, prosthetists-orthetists technicians, prosthetist engineers-technologists, prosthetist engineers, prosthetist mechanics;
- members of the supervisory boards of business entities that are of strategic importance for the economy and security of the state and whose asset value or annual net income exceeds UAH 200 million, as well as enterprises of particular importance to the economy, whose asset value exceeds UAH 2 billion or whose annual net income exceeds UAH 1.5 billion.
In view of the adjustments to Procedure No. 76, changes were also made to Criteria No. 76, in particular, the norms regarding the amount of the accrued average salary of insured persons - employees were clarified.
The resolution entered into force on April 2, 2025.
