The state guarantees free legal services to child victims in criminal proceedings

To receive such services, you need to contact the BPD system — the nearest legal aid bureau. The bureau will help you write an application for the provision of free secondary legal aid to your child, that is, for the appointment of a lawyer. The lawyer’s services are paid for from the State Budget of Ukraine.

What is this for?

When a child becomes a victim in criminal proceedings, it is important that their interests are protected during the investigation. Those accused in criminal proceedings always have a lawyer.

What documents do you need to submit to appoint a lawyer?

  • birth certificate of the child;
  • an extract from the Unified State Register of Pre-Trial Investigations, which indicates that the child is a victim in criminal proceedings;
  • if you are not the parents (adoptive parents) of the child, then a document confirming your authority as a legal representative.

Maria is a minor who suffered from sexual violence. The perpetrator was punished.

«"Maria suffered physical and moral suffering. In addition, the situation became public among her fellow villagers and at school. Because of this, she experienced even more stress and is in a depressed state," says the girl's mother.

To recover moral and material damages from the offender, Maria's mother turned to the BPD system in the interests of her daughter.

Children have the right to free legal assistance when applying to court. Therefore, the bureau's lawyer was authorized to represent their interests.

The lawyer studied the circumstances of the case and prepared a statement of claim for the court. In the justification of the claim, the specialist noted that the defendant committed a crime against the girl, he was found guilty of committing a criminal offense by the court verdict and was sentenced to 13 years in prison. An extract from the girl's medical record and receipts confirming the costs of treatment were attached to the statement.

The court satisfied the claim in full and decided to recover from the defendant 200 thousand UAH in moral and 3 thousand UAH in material damages.
